Research summary:

This paper addresses an important condition for woman marriage contract , which is the  Guardian, Jurists differ in defining the guardian who’s to  conduct her marriage , and there has been many views on its necessity , and many others about the legitimacy of the marriage without the guardian’s permission .

The difference was between Jurists , who considered the guardian as a condition , and between the Hanafis who didn’t consider it as a condition . the majority was a bit  more of the right way . and because of the many views regarding the guardian matter , therefore the personal conditions  law has changed . however , the valid  personal conditions laws in Palestine  are out of date , and some of them need to be reconsidered . so it would suit the current time , with regard to the Islamic law .
