This research entitled “The punishment of Raping a Woman and the sentence of aborting the Rape pregnancy Embryo in Islamic Jurisdiction“  is in three sections: introduction, discussion  and conclusion. The first is about the  ban and concept of rape. The second deals with the stage of development and growth of  the embryo. Here the Embryo goes three two stages:  soul blowing and after soul blowing. Then   

the results of study are presented

In the second section the researcher  talked about the necessary abortion where  the meaning and the judgment of abortion were considered. The this was followed by highlighting the meaning  necessary abortion,; its restrictions  and finally dealt with  cases of abortion that can be subsumed under it. Great   Emphasis is also  laid great  pinpointing the Shariah judgment on  abortion in  cases of rape, and adultery . Finally, in the third section I talked about the legal point of view about abortion by resorting to Shariah Scholars opinions . The research paper was concluded by research results and

 recommendations and  a list references.
