This research seeks to explain the definition of abortion ،why it is
considered a crime ،in addition to clarifying its elements and conditions
as well as the consequent judicial punishments. Abortion is a deliberate ،
unjustified termination of a pregnancy before the natural time of birth.
Abortion is prohibited in Islam because it violates the laws and orders of
Allah and a gains the right of the fetus to live ،a threat to the mother’s life
and an offense on community as a whole. The Islamic Criminal
Legislation lays down just punishments on those who commit this crime
including Al-Gurrah (Blood Money) ،Atonement (Kaffarah) ،and
deprivation of inheritance…etc whenever the crime’s conditions and
