This research is concerned with the study of the father’s division of his wealth before death among his children with the intention of inheritance, and aims to:
Clarifying the correct adaptation of this division, explaining the legal ruling and the sayings of the jurists, and stating the implications and related provisions such as this division, and I have followed the inductive approach and deductive approach, and I concluded from this research with several results, including: Correct adaptation of this division is a matter of gifts and gifts, urgency to divide A father’s money among his potential heirs is permissible if the interest of this division is more likely to him, and it is disliked in the absence of a justification and need, the most correct saying about the father’s division of his money between his children is like dividing the inheritance, for the male is like the luck of two females. For his children during his life, and in the event of the father’s death, the heirs have the right to re-divide in order to do justice to the rest of the new heirs.
Among the most important recommendations of the research:
We recommend that fathers rush to divide their property with the intention of inheritance and leave that for after death.
