The study concluded that it is difficult to determine who transmitted the virus to others - due to the nature of this virus, a person may be infected with it and not know that he is infected, and cause it to be transmitted to others without his knowledge at all, or there may be several people infected with the virus and he does not know who was the reason for transmitting it to others - so do not Punishment can be imposed without knowing the true carrier of the virus. And the responsibility resulting from the transmission of the Corona virus in Islamic criminal jurisprudence varies according to the type of damage caused by the transmission of the virus to others, and the extent of its impact on the individual or society by harm or destruction and loss of life or not, and accordingly, the intention of the carrier is to spread the disease among people and cause them harm, so it can be considered As a matter of militancy and corruption in the land, it can also be considered a disciplinary punishment that the ruler is punished with in proportion to the seriousness and impact of the crime, in order to achieve public order in the state, and if he intended to transfer it to the victim in order to kill him and he died from that, then he is punished with the penalty of semi-intentional killing, because the virus does not often kill And if some people died because of infection with it, and if he did not intend to kill the victim, and he died because of infection with it, then it is considered a case of accidental killing, as well as negligence and lack of precaution.
