Exploring the significant causes of disputes in green construction projects in Palestine

Purpose: Sustainable green construction projects are still emerging in Palestine. They suffer from the frequent occurrence of disputes among contractual parties (owner, designer, and contractor) which, in turn, hinder completing projects within time, cost, and desired quality. Although several previous studies have widely investigated the causes of disputes in construction projects, few have attempted to identify them in green construction projects. Hence, this study aims to identify and evaluate the causes of disputes in these kinds of projects in Palestine and assign the contractual party who has incurred the responsibility for each cause. Methods: In total, thirty-five causes of disputes in green construction projects were identified from literature and interviews with professional experts. After that, the questionnaire has been created and then distributed randomly to fifty professional experts: 15 owners, 15 designers, and 20 contractors. A five-point Likert scale has been used to determine the mean and the significance index for each of the identified causes to rank them accordingly. Next, the frequency is calculated to assign the contractual party who has the responsibility for each cause. Results and interpretation: The results displayed that the most significant cause of disputes was the poor management process adopted by all contractual parties. This can be attributed to their unfamiliarity with sustainable green construction projects since they are still in their infancy. In addition, the parties resort to assigning unqualified project managers due to the lack of specialized managers in sustainable construction projects, which hinders the success of such types of projects. Conclusion: This study provides a clear understanding of the critical causes of disputes in green construction projects in Palestine. It can be used as a guideline to enhance integration and coordination among contractual parties which, in turn, minimize adversarial and losses in the future. Moreover, the results are expected to improve the quality of green construction projects by enhancing capacity building and familiarity of contractual parties with the contract requirements in such projects.
