Legitimacy of Contracting Session’s Option
(New Envision)

This research aims to answer a question: How could we grasp the prophet’s saying concerning the contracting session’s option, without satisfaction of the apparent meaning, nor misinterpretation of it. The research followed inductive and analytic approach of the opinions and the arguments. The search is distinguished from previous studies through its new perspective. The search was divided into sex sections, dealed with the Concept of the Contracting Session’s Option, the views of Islam jurists about it, The arguments of both opposite views of Islam jurists about the subject and the discussions from each of them to the other. Display other texts in the subject, how some Islam jurists tried to pass from the apparent meaning to other interpretations, and what is our own new interpretation and its bases. The research concluded many results, the most important is that: The contracting session’s option depends on traditions and explicit or implicit deals. For exaple it exists in contracts related to quickly daily transactions, and doesn’t exist in written or witnessed contracts.
