This study examined one condition of testimony, namely, the effect of religious differences on the acceptance of non-Muslim testimony. The study aimed to illustrate the meaning of testimony and the guiding spirit on the texts in respect to this testimony , and also to state the judgment of non-Muslim testimony in the case of travel. To achieve these aims and to answer the main question, The study answered two sub-questions : What is the meaning of testimony in Islam ? and what is the  judgment of non-Muslim testimony in the case of travel ? I used the inductive approach, therefore I have concluded that the aims of testimony is to protect people’s rights Hence, it’s necessary to summon these aims,. according to the public of jurists the verse of testimony on the will is canceled. al Hanbali and al Thahiri schools  said that it is an arbitral one ,therefore , they legitimized the testimony of non-Muslim on will in the case of travel and I have outweighed this opinion. Ibn Taymiyyah went to legitimize the testimony of non-Muslim when necessary compared to the will in the case of travel. I have discussed this matter and outweighed Ibn Taymiyyah’s opinion.
