The right to health has been regulated by several international instruments. The regulation of this right had been initiated in the aftermath of the Second World War. However, this right has remained unclear, and undefined accurately. It has been regulated vaguely in the international agreements, which enabled some states to escape implementing it upon all its citizens, taking advantage of the ambiguous provisions and its inconspicuous wording.

This research paper tries to follow the developments that occurred to the legal regulation of the right to health, and the right to insurance, which is linked to it, since the Universal Declaration of the Human Rights, until the endorsement of the Palestinian Health Insurance System. The latter did not provide the Palestinian citizens with a full package of the medical services, and did not mitigate their financial burdens. Hence it has been vital to shed light on these legal developments that preceded the endorsement of the Health Insurance System, to clarify the backdrops that accompanied this System.
