this Article seeks to add a historical perspective to the drafting of the Palestinian Basic Law, an angle which has been largely over-looked in favor of comparative or theoretical analysis. Others’ over-sight of the history that surrounds the Basic Law is surprising, con-sidering the importance of the historical context that led to the document’s formation. Many often overlooked factors sit directly in front of scholars: the Oslo Accords, other Arab State’s Constitutions, and past Palestinian Constitutional struggles. It is these factors, and ignorance of the Palestinian people, that created the flaws, and ulti-mate failure, of the Basic Law as a constitutional document.
