The Complex Task: Can the Palestinian Law of Arbitration Become More User-friendly Towards International Commercial Arbitration?

This article reviews the current approach of Palestinian law toward international commercial arbitration and how it can be improved through harmonization with international best practices and other comparative legal systems. It will analyse the best approach that the Palestinian legislator should adopt to define the international nature of arbitration, considering Palestine's hard legal reality. Further, this article highlights the importance of harmonising the law and practices of the Palestinian law with international best practices and approaches and, therefore, reduce the impact of outdated legal standards on international commercial arbitration. Finally, this article argues that having an efficient, reliable, and harmonised arbitration environment requires a balanced judicial review approach that reflects the consensual nature of international arbitration, which desires a dispute settlement mechanism free from judicial intervention.
